NBT Bancorp and its subsidiaries (“The Bank”)—including but not limited to NBT Bank, N.A.; NBT Financial Services, Inc.; NBT Settlement Services, LLC; Pennstar Bank, a division of NBT Bank,
N.A.; Pennstar Management Trust, a division of NBT Bank, N.A.; Pennstar Financial Services, Inc.; EPIC Advisors, Inc.;
The Hathaway Insurance Agency, Inc.; and Colonial Financial Services, Inc. —require that each visitor (“User”) to its web site(s) (“Our Site”) adhere to the following user agreement, and such other agreements, if any, required by The Bank for specific services or products. By accessing Our Site, User indicates User’s acceptance of and agreement to these terms and conditions, as amended, and each amendment thereto from time to time by The Bank (the “Web Site User Agreement”).
1. Banking Services: Deposit, loan and other types of products or services provided by The Bank may have their own rules, regulations, disclosures and agreements which were provided to you at the time the account was opened.
2. General Disclaimer: Our Site may contain links to third-party web sites that you may find useful, and these are provided for your convenience. The Bank does not control the third-party sites and is therefore not responsible for any information contained on those sites. The Bank does not endorse any information contained in those sites. The Bank is not responsible for the accuracy or reliability of any information, data, product, opinions, advice or statements made on these third-party sites. These third-party sites may have their own privacy policies. You should review the privacy policy of any web site before you provide personal or confidential information.
There are risks in using any information, software, products or services found on the Internet; Users should completely understand these risks before retrieving, using, relying upon or purchasing anything through the Internet. Access to this and other Internet sites linked to Our Site is at the User’s own risk, and Users are advised to verify the information on this and any other web site prior to relying on its information. The Bank disclaims any responsibility for loss or damage caused through any product, service, offer, failure of performance, inaccessibility, computer virus, error or omission listed on, accessed from or downloaded from Our Site or third-party web sites.
3. Disclosure of Account or Personal Information to Third Parties: The Bank protects confidential information about our customers. Please read our Privacy Statement.
4. Transmission of Data: User acknowledges and agrees that by providing The Bank with any personal or proprietary User information through Our Site that the User consents to the transmission of such personal or proprietary User-related information to The Bank, its agents and processors. Users should not send confidential information such as account numbers through E-Mail as E-Mail may not be secure.
5. Investment Products: Nondeposit investment products and insurance products are made available through The Bank. Securities (including mutual funds), insurance products and annuities are not bank deposits and are not insured by FDIC or by any federal government agency, nor are they obligations of or guaranteed by The Bank. Securities, insurance products and annuities involve investment risks, including the possible loss of the principal amount invested.
6. Electronic Authentication or Signature; Electronic Records: The Bank may use commercially reasonable authentication procedures to: (a) verify the identity of a sender of electronic records; (b) determine the electronic record has not been altered during transmission or storage; and (c) authenticate the sender’s electronic signature and attribute the electronic record to such sender.
7. Enforceability of Electronic Records: Any record containing an electronic signature shall be deemed for all purposes to have been “signed” and will constitute an “original” when printed from electronic records established and maintained by The Bank or its agents in the normal course of business. User agrees not to contest the authorization, validity or enforceability of electronic records or the admissibility of copies thereof. Electronic records and signed documents, if introduced as evidence on paper in any judicial or other proceedings will be admissible to the same extent and under the same conditions as other documentary business records. Upon The Bank’s request, User agrees to manually sign or place User’s signature on any paper original of any electronic record that The Bank provides to User containing User’s purported electronic signature.
